South Dakota has no DPC laws at present, but the state is off to a great start in 2021 with HB 1131. This bill is well drafted and deserves your full support. The legislative summary here shows that HB 1131 passed the House on 02/24/21 with a vote of 63-2. It passed the Senate 35-0 on 03/08/21 and it is currently awaiting the governors signature to become law. and no DPC practices are known to be operating within the state. Be sure to review the South Dakota Insurance Code when planning your DPC practice.
With HB 1154 South Dakota is also about to join the list of states that simply do not allow health care providers to be subject to noncompete agreements. This 2021 bill is also awaiting the governor’s signature and will become law when signed.
